NO!!! You will have plenty of time to tell your side of the story in court if you choose to do so. Nothing you tell the police can be admitted to help you - it's hearsay. But every word you tell them is admissible against you as an admission by party opponent. Tell your side of the story to your attorney and let your attorney speak to the police.
They already think you're guilty. That's why they charged you with a crime. Hiring an attorney will not make them believe you are any more guilty. It will only make them think you are smart enough to hire an attorney.
A criminal defense attorney's top priority is keeping you out of jail - not clearing your name. Most not guilty verdicts do not result from proving your innocence; they result from creating reasonable doubt about your guilt. The burden of proof is very high and you may escape punishment even if the judge or jury think you probably did the thing you are accused of doing. Probably isn't enough. When possible, we try to exonerate our clients in every respect, but we focus on avoiding convictions or negotiating reduced charges and shorter sentences.
In most practice areas, we prefer contingency agreements because it rewards excellent results. Unfortunately, criminal defense is one area of the law where contingency agreements are not permitted. When possible, we enter flat-fee agreements so you know exactly what our services will cost. For particularly complicated cases, we may have to enter an hourly agreement with a substantial retainer paid up front. In those cases, we will provide you a detailed description of what we've done in your case and the amount of time required to do it. Whatever the terms, we clearly communicate how your money is being spent.
That depends. We are very selective in the types of criminal defense cases we accept. Please do not be offended if we decline representation. We only accept cases in situations where we believe we can make a difference in the outcome and criminal defense is no exception. We accept 6-8 criminal defense cases per year. To find out if we will take your case, call today to speak with one of our criminal defense attorneys.
