- Labor & Employment

Branham et al. v. Anam Care et al. (W.D. Va. 2025)

Settled wage theft/retaliation claims against local employer arising out of internal complaints our clients made about wage theft, misclassification, and alleged fraud.

Torimika Hairston v. Nilit Am., Inc. (W.D. Va. 2024)

Settled discrimination/retaliation claims against Martinsville employer arising out of internal complaints our client made about race-based discrimination.  The opinion denying the employer's motion to dismiss has been widely cited throughout Virginia federal courts because it opened the door for Virginia Human Rights Act claims that had not been filed directly with the Virginia Office of Civil Rights.

Austin Jenkins v. ELDOR Automotive (W.D. Va. 2024)

Settled complex class-action claims against local employer for failing to pay employees for work performed before their shift officially started and failing to include non-discretionary bonuses in employees' regular rates of pay, resulting in underpayment of their overtime premiums.  Under the settlement agreement, employees received double the amount withheld, plus 8% interest.  Our firm did not take a penny of this money, because the employer paid additional money to cover our fees!

Joyce Bolender v. Bio-Medical Applications (W.D. Va. 2024)

Helped older employee who was terminated for a similar offense a younger employee committed without being disciplined.  Age discrimination cases are very hard, but this one turned out well.  The case was featured in multiple legal journals, including Virginia Lawyers Weekly, in part because the Court allowed our client to pursue claims against all entities in the chain leading back to the parent corporation applying a legal theory called the Integrated Employer Doctrine.  The full text of the opinion is available here.

Regina Fretwell v. Pallu Hospitality LLC (W.D. Va. 2024)

Settled wage theft and retaliation claims against Martinsville employer arising out of internal complaints our client made about unpaid overtime and misclassification.  The client received nearly a year's salary even after our fees were paid.

Confidential Workplace Violence Retaliation Settlement (2023)

Successfully settled whistleblower claims against Lynchburg business resulting in 6-figure settlement after employee was terminated for complaining about workplace violence.

Faith Hammer v. Johnson Senior Center, et al. (W.D. Va. 2021)

Helped former employee whose employer failed to remit health insurance premiums deducted from her paychecks.  $300,000 judgment, plus attorney fees, recovered for the client!  This case has been published in various employment journals around the country and is available here.

Maggard v. Kids Central, Inc. (W.D. Va. 2020)

Defeated Motion to Dismiss based on alleged untimely filing in novel pregnancy discrimination claim resulting in a confidential settlement.

Confidential Title VII Race Discrimination Settlement
