 • Alvin Bacon v. Caci Int’l, Inc. and AIG (Dept. of Labor 2022); successfully authored Post-Hearing Brief on behalf of former defense contractor-claimant suffering from PTSD, resulting in judgment for the claimant granting significant disability compensation and medical benefits for psychological injuries under the Defense Base Act, plus attorney fees

  • Oldham v. Centra Health, Inc. (W.D. Va. 2021); successfully briefed, delivered oral argument, and defeated hospital's motion to dismiss plaintiff's retaliation claims arising under the False Claims Act's “protected activity” provisions 

 • “Religious Educational Institution” v. “New York Corp.” (Roanoke 2021); successfully litigated fraud claim on behalf of plaintiff-educational institution against large national corporation headquartered in New York resulting in confidential settlement plus attorney fees  

• “Roanoke Resident” v. “Lynchburg Defendant” (Lynchburg 2022); successfully litigated plaintiff’s personal injury claims resulting in confidential settlement awarding the plaintiff the insurance company’s maximum policy limit  

 • COVID-19 CLAIMS - Yugo Collins attorneys successfully filed and settled multiple claims related to Virginia’s Emergency Temporary Standard (ETS) established to protect workers from Covid-19 exposure in the workplace 

• Brennan Gilmore. v. Jones et al., (W.D. Va. 2021); successfully negotiated full resolution & dismissal with prejudice of defamation claims against corporate media entity client & officer sued for defamation following news publication related to Unite the Right rally in Charlottesville 

 • successfully drafted 20-page supplemental brief in support of individual defendant’s 12(b)(6) motion to dismiss all defamation counts involving Flint, Michigan, water poisoning defamation action; Court ultimately dismissed entire Complaint that sought $3 million in damages (W.D. Va. 2019) 

 • Bruce Abramski, Jr. v. Robert Asbury, (Roanoke 2018); successfully defended state defamation suit; drafted all motions (demurrers, pleas in bar, motion craving oyer, answer, and affirmative defenses) and brief in support of motions resulting in dismissal with prejudice (with an Order granting demurrer and plea in bar, on the merits) of a $200,000 defamation suit in Roanoke Circuit Court 

• successfully negotiated voluntary withdrawal of federal criminal subpoena; represented client in negotiations with USAO (E.D. Va. Richmond) 

• successfully negotiated voluntary withdrawal of federal civil subpoena duces tecum on “technical defect” grounds; represented client in negotiations with USAO and administrative agency (D.C.) 

• successfully quashed a foreign subpoena duces tecum on “technical defect” grounds; drafted all pleadings and delivered oral argument on behalf of corporate client subpoenaed as third-party record-keeper for out- of-state transaction (Charlottesville Circuit Court) 

• successfully defeated subpoena duces tecum; obtaining temporary due deference deferral and continuance on comity grounds (pleadings & oral argument) 

• successfully obtained withdrawal of Motion to Compel production in foreign state on jurisdictional grounds  

• successfully defended healthcare provider by drafting federal court pleadings on a motion to dismiss a federal FCA/qui tam action for failure to plead fraud with particularity under Rule 9(b) 

• successfully drafted motion to dismiss a federal suit involving Eighth Amendment challenges 

• successfully negotiated with foreign embassy on behalf of white-collar client to obtain reinstatement of health benefits for client in foreign country 

• successfully drafted bond appeal for defendant in federal district court for highly publicized fraud case involving university research and National Science Foundation (NSF) grant fraud; obtained release on bond 

• successfully represented corporate client and its two individual officers by winning all four (4) demurrers against charges of actual fraud, breach of fiduciary duty, and breach of various bylaws (pleadings and delivered oral argument in Circuit Court) 

• successfully defended criminal client at trial in state court on charges resulting from serious boating accident on Smith Mountain Lake that caused passenger to lose fingers and thumb; obtained Not Guilty verdict 

• successfully defended client in state court on criminal charges resulting from car accident and significant injuries; successfully tried case against Commonwealth’s Attorney and won on defense Motion to Strike; obtained dismissal of all charges 

• successfully obtained dismissal with prejudice of $1.35 million wrongful death action; drafted all pleadings and dispositive motion; delivered oral argument in Circuit Court
